Former FBI Employee Asserts Wrongful Dismissal Due to Pride Symbol Exhibition
A long-serving FBI intelligence specialist has initiated a legal case claiming he was dismissed for having a rainbow symbol at his office space.
According to David Maltinsky, that was employed in the agency over a decade and a half, his firing recently is being described as “unconstitutional and politically motivated”.
Legal Proceedings Alleges First Amendment Violations
The legal filing contends that the agency breached Maltinsky’s free speech protections and engaged in retaliatory steps in his case due to expressing constitutionally covered expression.
The plaintiff is requesting a court order to restore his job at the bureau.

The detailed filing, lodged in federal court in Washington, D.C., claims that the employee was dismissed from his training in October because of earlier displaying the Pride symbol on his desk.
Per the complaint, the rainbow symbol was given to the employee to honor his efforts to support the bureau’s diversity initiatives.
Early on, my goal has been to serve the United States and protect public safety beside the skilled and devoted personnel at the agency,” said Maltinsky.
He continued, “I displayed that Pride flag – which in 2021 was raised before a federal building – not for political reasons, but rather as an emblem of acceptance, solidarity and impartial service.
These principles that once made the bureau effective. Now it is a place where individuals such as myself are targeted. I think I was dismissed not because of who I am, but what I am: a proud gay man,” he affirmed.
Sudden Dismissal Prior to Graduation
In the past months, the employee gained admission to the federal agent training program at the FBI facility, until what he called “unexpected firing shortly before finishing”.
The lawsuit also claims that eventually following Donald Trump’s inauguration, a co-worker expressed an alleged concern to his manager regarding the exhibition of the LGBTQ+ symbol.
“Out of an abundance of caution, the plaintiff asked that the legal advisor for the Los Angeles field office examine if the presence of the symbol was permissible,” the filing said.
It added, The legal officer told the employee that exhibiting of the symbol did not violate any policy, rule, or regulation.”
Notice of Termination
However, on 1 October, Maltinsky was notified of his termination.
In correspondence referenced in the complaint, agency head Kash Patel stated, “I have determined that you exercised bad decision-making by exhibiting of a political symbol in your work area in your prior role at the Los Angeles Field Office.
Under Article II of the Constitution, and the laws of the U.S., your job at the bureau is concluded.”
Attorney Remarks
In comments issued recently, Maltinsky’s lawyer his counsel stated, The current leadership’s unlawfully firing him is part of an extensive initiative to rid federal agencies of staff who may have divergent opinions, or are from minority populations, or individuals that challenge discrimination.
“David’s fight goes beyond his situation, but also about ensuring the liberties and protections of all public servants.”
Bureau Reaction
The bureau declined to comment about the legal action.

This legal action comes after an additional filing lodged recently by three former top agency personnel who alleged they were unlawfully fired.
They stated that the official said he had been ordered by the president’s office to fire any official associated with a probe concerning Donald Trump.
Meanwhile, the bureau dismissed an experienced official recently subsequent to Patel allegedly grew upset due to accounts that the bureau chief used a federal plane to go to a match where his girlfriend performed the anthem.
